Except the first time they never do the imperius and Harry was never in one. A person in imperius can’t put another under it. He was all suggestion.

A few things spring to mind from reading this:

First, since the Imperius Curse requires the caster to truly believe and want to control another person totally, it would be hard verging on impossible, for Harry to accidentally cast it on Hermione, unless their relationship is a lot darker in this story than canon.

Second, you might be able to cast it on yourself, since desiring self control and believing you should have inviolable free will would almost certainly count as the belief and desire necessary to cast it.

Third, the basic premise to the use of the Imperius Curse is an excellent example of why fanfic authors who have characters saying spell incantations instead of the name of the spell when referring to it just makes no sense. Imagine someone pulling out a pistol and firing a shot into the ceiling instead of saying the word "bang" - it's pretty crazy to imagine, but that's literally what a magical person is doing when they say "Avada Kedavra" instead of "Killing Curse" when discussing that spell. Imagine how a crowd of people would react if someone pulled out an AK-47 and aimed it at the crowd they were in. If you started to say "Avada Kedavra" near a crowd of magicals, they'd react the same way - some, such as Mad-Eye Moody, would already be casting lethal spells at you before you completed the second syllable. And that's on top of the risk of negligent discharges.
